Brief Description

The Head of Claims and Contract Compliance will be responsible for undertaking assurance and reporting on high value complex claims and variations, in line with compliance to contract, company and corporate policy & objectives. The role holder will provide expert advice on the resolution of any disputes, acting as a subject matter expert.

You will provide leadership, subject matter expertise, assurance & consistency in the reporting, management and resolution of high value complex claims and variations, in line with compliance to contract, company and corporate policy & objectives, in liaison with Commercial Teams, Legal Services, Insurance and other mandated review panels
About the role (External)

Key Accountabilities
To understand and inform on the key commercial issues on all significant claims, regularly reporting on potential liabilities/recoveries and progress in the management & settlement of claims, developing & maintain appropriate key performance indicators and targets.
To identify and support the settlement of claims by and against the business, including directing the instruction of expert and professional advisers on dispute resolution issues and supporting Legal Services in the management of any related legal proceedings.
To provide feedback and support to the businesses on best practice for the resolution of claims and champion strategies for the avoidance/minimisation of future claims through the development, deployment & maintenance of effective lessons learned programmes.
To define practitioners' required levels of competency and develop & maintain effective training & development collateral to improve our capability in the avoidance, management & resolution of claims.
Where necessary, to directly support, lead, facilitate & negotiate the resolution of significant claims.
To advise on update of the standard suite of contracts with particular emphasis on matters relevant to the avoidance & management of claims, including regular review and improvements to standard terms.
Where appropriate, to carry out a pre-contract review of significant, high value, complex or novel contract documentation for compliance with approved strategy, fitness for purpose and the minimisation of risks and liabilities, including exposure to claims to Infrastructure Projects.
To establish & maintain a network of Subject Matter Experts to ensure a 'virtual team' capability.
To maintain a programme of assurance, auditing and monitoring to improve the standard of claims management and associated contract administration competency.
To attend where necessary and liaise across Network Rail in the operation of the various Commercial Review Panels.

Job Skills, Experience and Qualifications


  • Experience & expertise in contract law, contractual litigation and contractual dispute resolution of contracts valued up to £30m
  • Educated to degree or equivalent level, preferably in an engineering or construction related sector and/or construction law/dispute resolution
  • Significant experience in the resolution of complex claims
  • Significant experience in the commercial management and resolution of high value, complex contracting situations
  • Significant knowledge of various standard forms of contract and their application and/or amendment to reflect particular contracting situations
  • Strong commercial acumen and negotiating skills
  • Strong interpersonal skills and ability to interact with all levels of the organisation up to and including senior management
  • Excellent reporting skills, with the ability to digest, manipulate and summarise key data
  • Numerical and analytical skills


  • Full chartered membership of a relevant professional institution, such as RICS, CICES, CIARB or similar
  • Fellow of a relevant professional institution, such as RICS, CICES, CIARB or similar
  • Background in engineering, construction, or other related sectors
